What Is Kuwait Gratuity?

Gratuity, also called end-of-service indemnity, is an amount that may become payable when a private-sector employee’s employment ends in Kuwait. The calculation depends on the employee’s regular remuneration, length of service and the reason the employment relationship ended.

For a monthly paid employee, Kuwait Labour Law provides 15 days’ wage for each year during the first five years and one month’s wage for each year after five years. A fraction of a year is calculated proportionately. The statutory amount for a monthly paid employee is generally capped at one and a half years’ remuneration.

How to Use the Kuwait Gratuity Calculator

Enter the employee’s last regular monthly remuneration, employment start date, last working date and reason for leaving. The calculator uses a 26-working-day basis to estimate the daily wage and applies the statutory formula for monthly paid private-sector employees.

The salary field should not automatically be limited to basic salary. Under the wage provisions of Kuwait Labour Law, regular allowances, remuneration, commissions and cash benefits may form part of the wage where they are paid periodically. Variable cash or in-kind benefits may need to be averaged. Use the remuneration that is legally relevant to the employee’s circumstances rather than entering an unsupported figure.

How Resignation Affects the Estimate

An employee leaving under a full-entitlement situation, such as an eligible employer termination or expiry of a limited contract, may receive the full calculated indemnity. Different rules apply when an employee resigns from an unlimited contract.

For such a resignation, an employee with less than three years of service ordinarily receives no statutory indemnity. Service of at least three but less than five years may qualify for one-half of the calculated amount. Service of at least five but less than ten years may qualify for two-thirds, while an employee completing ten years may qualify for the full amount.

Why the Final Settlement May Be Different

The calculator provides an estimate only. The final amount can differ because of the employment contract, salary components, unpaid leave, breaks in service, outstanding debts, the legal ground for termination or a more beneficial company policy.

The result also excludes other final-settlement items such as unpaid salary, unused annual leave, notice pay, bonuses, expenses or compensation. Domestic workers, government employees, oil-sector workers, daily paid workers and employees dismissed under circumstances that may remove entitlement require a separate calculation.

Employers should verify the employee’s service records, remuneration history and termination documents before approving a final settlement. Employees should review their contract and supporting payroll records if the amount paid differs from the estimate.
