How to Calculate End of Service Benefits in Qatar

End of service benefits in Qatar is defined as the amount that is to be paid to an outgoing worker by the employer on the basis of the time period of service. Other than the number of service years, it also depends on the employment contract between the employee and the employer.

According to the Labor Law no. 21 of 2015 which was enforced in Qatar in December 2016, it is mandatory for the employer to provide an outgoing employee with the end of service benefits and keep a record of all such benefits given to various employees. Who Can Get End of Service Benefits In Qatar?

Any outgoing worker can demand the end of service gratuity in the following cases;

  1. An employee who terminates a contract because the employer breached the labor law or refused to perform his obligations as set in the employment contract can obtain the end of service gratuity with full right.
  2. An employee who terminates a contract because the actions of the employer or his representatives are immoral or physically assaulting towards the employee or his relatives can demand the end of service gratuity with full right.
  3. An employee who terminates a contract because he is continuously misled during the job and the employer does not take any action can get the end of service gratuity with full right.
  4. An employee who terminates the contract because it continues to pose threats to the health and safety of the employee while the employer has the knowledge of it can get the end of service gratuity with full right.
  5. An employee who has worked for at least one year time period can obtain the end of service benefits upon termination or retirement.
  6. An employee who is already getting benefited by the retirement system even greater than the end of service gratuity can not obtain end of service gratuity.
  7. An employee who is getting benefited by the retirement system which is less than the end of service gratuity can get the end of service gratuity with full rights.
  8. An employee who can either be given retirement benefits or end of service gratuity has the option to choose any one of them.
  9. An employee can obtain the end of service gratuity in such a way that it is agreed by both the employer and the employee, is not less than the wage of three weeks per year, and is calculated on the basis of the last set wage.

Who Can Be Dismissed From End of Service Benefits in Qatar?

Following are the situations in which an employer can terminate an employee without any notice and end of service benefits as per the Qatar labor law;

  1. An employee who gets the job by providing false information and false documents to the employer can be dismissed from getting end of service gratuity upon termination.
  2. An employee whose actions result in gross financial loss to the company of the employer can be terminated without getting end of service gratuity. In this case, it is mandatory for the employer to notice the incident within 24 hours and involve the relevant department.
  3. An employee who continuously violates the rules and regulations of the company, poses threat to the safety of other workers, and does not stop violations upon written notices from the employer can be terminated by the employer without any end of service gratuity given to him.
  4. An employee who fails to perform his particular duties for the company as per the employment contract and does not improve his performance even after written notices from the employer can be terminated without any end of service gratuity given by the employer.
  5. An employee who poses a threat to the privacy of the company where he works and discloses information or secrets personal to the company can be dismissed from getting end of service gratuity upon termination.
  6. An employee who is found even a single time taking drugs or in any type of drunkenness state can be dismissed by the employer from the end of service gratuity upon termination.
  7. An employee whose behavior is found assaulting towards any superior category worker, supervisor, manager, etc, of the company can be dismissed without the end of service gratuity given by the employer upon termination.
  8. An employee whose behavior is found assaultive and harmful towards his colleagues and other workers in the company and who does not change his behavior upon written notices by the employer can be terminated without end of service gratuity.
  9. An employee can be terminated and dismissed from the end of service gratuity if he absents himself from work for fifteen days in a year without notifying the company with reasons.
  10. An employee can be terminated and dismissed from the end of service gratuity if he absents himself from work for seven days consecutively without notifying the employer or the company.
  11. An employee who has been legally sentenced for his dishonestly, immorality, assault, or any other crime, can be terminated without due end of service gratuity given by the employer.
